It is unfortunately necessary to make clear our terms and conditions. At times they get a bit technical and appear quite formal. Their purpose is to make clear your obligations and rights when shopping with us and using our services. I suggest you make yourself comfortable and prepare your favourite beverage before reading further.

These terms and conditions apply to the your use of the website drapiere.com and to your relationship with Carolyn de la Drapiere Ltd. By using drapiere.com or placing an order with Carolyn de la Drapiere Ltd, you are agreeing to accept these terms and conditions. You should be aware that these terms and conditions may change at any time. It is your responsibility to check them before using our services and/or placing an order.

Carolyn de la Drapiere Ltd reserves the right to cancel all agreements with you including the termination of your access to our website immediately and without notice to you if :-

• You breach any of our terms and conditions.

• You fail to make a payment to us when it is due.

• You do not provide to us within a reasonable period of time sufficient information for us to verify the accuracy of details you have previously provided to us or required to confirm your identity.

• We have reason to suspect that you are about to engage in or are involved in some form of fraudulent or illegal activity.

Your statutory rights are not affected by these terms and conditions.

Account details

When opening an account on drapiere.com you provide us with an email address that is used as a username and a password. You are responsible for all actions taken under this account. You must not open multiple accounts with us. It is your responsibility to keep your password secure. If you ever suspect that someone else knows your password then you must change your password immediately. You may not transfer or sell your username to anyone, nor permit, either directly or indirectly, anyone to use your username or password.

You warrant that the details you have provided us when opening an account and within all communications with us are true, accurate, current and complete in all respects.

You agree that email is an acceptable way for us to communicate with you.

If there are any details that you have previously provided to us that have changed it is you responsibility to change them using the online account maintenance facility.

It is a criminal offence to use a false name or to use an invalid credit card. Anyone caught deliberately using false or invalid details while using our services will be prosecuted to the fullest extent of the law. Carolyn de la Drapiere Ltd records electronic details that will enable us, fraud investigators and law enforcement officers to trace individual users engaging in criminal activities while using our website and services.

Ordering

When placing an order with Drapiere.com your contract is with Carolyn de la Drapiere Ltd.

By placing an order with Carolyn de la Drapiere Ltd you are making an offer to buy our products and/or services.

All product prices on our website are displayed in pounds sterling and are inclusive of VAT and exclusive of postage and packing charges, unless otherwise specified. All product prices shown on drapiere.com are applicable at the time of order only and relate to purchases made through our website only. Carolyn de la Drapiere Ltd will only accept orders if there are no errors in the prices of the products ordered as displayed on our website. Carolyn de la Drapiere reserves the right to change prices at any time.

A contract for sale does not exist between you and Carolyn de la Drapiere Ltd until the point your order is dispatched to you. By dispatching the products we accept your order. We will confirm dispatch of your products by email. This confirmation email will be sent to the email address provided in your order and will include the products ordered, costs including Value Added Tax (VAT) and post/packaging, billing and delivery addresses. It is your responsibility to check all the details on this confirmation to ensure they are correct. You should notify us immediately if any of the details are incorrect.

Your credit or debit card will not be charged for your order until the items are dispatched. Where applicable this will include a non-refundable charge for postage and packaging.

If your order has not been accepted, we will send you an email explaining the reason why.

You agree that all goods ordered by you are for you own private and domestic use only, and will not be offered for resale.

You are at least eighteen years of age. If you are under eighteen years of age you are only permitted to use this site with the agreement of, and under the supervision of, a parent or guardian. If you do not meet these conditions then please do not use this web site or place any orders with us.

You warrant that the details you have provided us when placing an order and within all communications with us are true, accurate, current and complete in all respects.

You warrant that the credit or debit card used to place an order is your own and that there are sufficient funds in your account to cover the purchases you have made from us.

When paying by credit or debit card your transaction will be subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery.

Availability

All orders are subject to acceptance and product availability. Product availability displayed within the website is indicative. Product availability is not fully confirmed until the point at which the order is dispatched.

If there is insufficient stock to deliver the goods you have ordered, we will not charge your credit or debit card for these items until the items are back in stock and are despatched.

In the unlikely event that your ordered products are no longer available, we may supply you with substitute products. If you decide not to accept the substitute products, you will not have to pay to return them to us.

Delivery

All delivery times given are estimates. We make every effect to deliver your order within the estimated delivery time. There are however occasions when due to unforeseen factors a delay occurs. Carolyn de la Drapiere Ltd shall not be held liable for any delay or failure to deliver goods within the estimated delivery times.

Your order will be sent to the delivery address on your order confirmation email. If you have ordered multiple products, you may be sent these items in instalments according to product availability.

If the delivery address is outside the UK, you are responsible for the payment of any import duties and taxes due prior to collection of your order. We recommend you contact your local customs office prior to placing an order to confirm the procedure and cost of importing our products.

Promotional delivery offers are not applicable to customer orders that are applying a competition prize promotion.

Cancellations

If you have products in your shopping bag that you not longer require and have not yet placed an order for them, simple navigate to the 'Shopping Bag' option within our website and remove the items.

An order that has already been sent to us may be cancelled at any time prior to it being dispatched. The request to cancel an order must be received and accepted by Carolyn de la Drapiere Ltd prior to the order being dispatched.

To cancel an order login to our website and navigate to the 'Track Orders' option and select 'Cancel'. This can only be done if the order has not yet been dispatched'. If you wish to cancel an order after it has been dispatched you will have to wait for the items to arrive and return them to us. Please read the 'Returns' section for further details.

Returns

If the items you wish to return have not yet been dispatched then please cancel your order. Refer to the ''Cancellations'' sections for further details.

We always hope you will be delighted with purchases made from the Carolyn de la Drapiere online boutique, but if for any reason you are not completely satisfied you can cancel your contract with us at any time up to 14 calendar days after the date that the items were dispatched from our boutique. The following conditions must also be met :-

• The products must be returned in identical condition to that which they were received.

• All tags attached to the product must be in original condition and must not have been removed at any time.

• The product must be wrapped in the same manner as it was received in.

• The products may be tried on to check the size and style but must not be worn for any extended period of time.

• You are the purchaser of the product(s).

We strongly recommend that you use a registered postage service with appropriate insurance to return the items. If Carolyn de la Drapiere Ltd does not receive your returned items you will be liable for the cost of the items.

Once we have received your returned products and have accepted that they meet our returns conditions we will refund the cost of the items using the payment method and account used to purchase the products within 30 days of receiving the returned items.

You will be liable for any charges incurred when returning the products to Carolyn de la Drapiere unless the return is due to an error on our part.

Liability

• Total liability for any claim against Carolyn de la Drapiere Ltd, howsoever arising, shall not exceed the price of the goods supplied by Carolyn de la Drapiere Ltd to the customer.

• You agree that if you break these Conditions, or any liabilities are incurred arising out of your use of this website, you will be responsible for the costs and expenses that we or our officers, directors, employees, agents and suppliers incur as a result of the breach, including any reasonable legal fees. You will remain liable if another person uses your account with us and/or personal information unless you can prove that this usage was fraudulent.

• We do not accept liability (except as set out below) for any errors and/or omissions within our website and reserve the right to change images, descriptions, prices, specifications, information, products and services at any time and without notice.

• If you receive goods that are not what you ordered or are damaged or defective then return them to us with a letter describing the issues. Include in the letter whether you would like a replacement product or a refund. All returned products must confirm to the conditions outlined in our returns policy. We will refund the return postage cost subject to the return being due to an error on our part. This provision does not affect your statutory rights.

• We are careful to ensure that the product images for each product for sale on our website are accurate however due to various reasons such as the browser you are using and settings on your monitor/screen we cannot be held responsible or liable for any differences in colour between the image and the actual product your receive.

• In the unlikely event that an error is found in the price of the products that you have ordered, we will inform you as soon as is feasible. We shall be under no obligation to fulfil an order for a product that was advertised at an incorrect price.

• The products sold by Carolyn de la Drapiere Ltd are provided for private domestic and consumer use only. Accordingly, we do not accept liability for any indirect loss, consequential loss, loss of data, loss of income or profit, loss of damage to property and/or loss from claims of third parties arising out of the use of the drapiere.com.

• We have taken every reasonable measure to prevent Internet fraud and ensure any data collected from you is stored as securely and safely as possible. However, we cannot be held liable in the extremely unlikely event of a breach in our secure computer servers.

• We shall have no liability to you for any delay in the delivery of products and/or services to the extent that the delay is due to any event outside our reasonable control, including but not limited to war, flood, fire, customs issues, labour disputes, strikes, lock-outs, riots, civil commotion, acts of God, malicious damage, explosion, governmental actions and any other similar events.

• We make no warranty that the drapiere.com will satisfy your requirements or will be timely or error-free, uninterrupted, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the Website. We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the Website.

• We will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent or negligent misrepresentations) or otherwise out of or in connection with the conditions for:-

• • Any loss of goodwill or reputation; or

  • Any special or indirect losses suffered or incurred by that party arising out of or in connection with the provisions of any matter under the Conditions; or

  • Any economic losses (including without limitation loss of profits, revenues, contracts, business or anticipated savings).

  • To the fullest extent permitted under applicable law, we disclaim any and all warranties of any kind, whether explicit or implied, in relation to the Products and services. This does not affect your statutory rights as a consumer, nor does it affect your Contract Cancellation Rights.

By accessing drapiere.com, you are agreeing that you may only download the content for your own personal and non-commercial use. You are not permitted to copy, download, broadcast, store on any medium, transmit, show or play in public, adapt or modify in any way the content of the drapiere.com web pages for any other purpose whatsoever without the prior written permission of Carolyn de la Drapiere Ltd.

Third Party Information

We are not responsible for the accuracy of any material or prices displayed on third party websites or contained in other mediums.

Waiver

No waiver given by us shall be interpreted as a waiver of any past or future breach of any provision.

Survival

Each provision of the Conditions shall be interpreted as separately applying and surviving even in the circumstance that one or other of those provisions is held to be unenforceable or inapplicable.

Entire agreement

These Conditions regulate our relationship with you. Any modification of these Conditions must be in writing and signed by both parties. Law

English law applies to all orders placed with, and services provided by Carolyn de la Drapiere Ltd, and any disputes will be heard in the courts of England and Wales.
